Know Your Rights: The New JerseyÌýCampus Sexual Assault Victim’s Bill of Rights

Pursuant to NJSA 18A, Chapter 61E

A college or university inÌýa free society must be devotedÌýto the pursuit of truthÌýandÌýknowledge through reasonÌýandÌýopenÌýcommunication among its members. Academic communities acknowledge the necessity of beingÌýintellectually stimulating where theÌýdiversity of ideas is valued. Its rules must be conceivedÌýfor the purpose of furthering andÌýprotecting the rights of all members of theÌýcollege community in achieving these ends. The boundaries of personal freedom are limitedÌýto applicable state and federal laws and Ìýinstitutional rules and regulations governing interpersonal behavior. InÌýcreating a community free from violence, sexual assault andÌýnon­consensual sexual contact, respect for the individual and humanÌýdignity are of paramount importance. The state of New JerseyÌýrecognizes that the impact of violence on its victims andÌýthe surroundingÌýcommunity canÌýbe severe and longÌýlasting. Thus, it hasÌýestablishedÌýthis Bill of Rights to articulate requirements for policies, procedures and services designed to insure that the needs of Ìývictims are met andÌýthat the colleges and universities inÌýNew Jersey create and maintain communities that support humanÌýdignity.

Bill of RightsÌý

The followingÌýRights shall be accordedÌýto victims of sexual assault that occur:

  • on the campus of any public or independent institution of higher educationÌýinÌýthe state of New Jersey, and
  • where the victim orÌýallegedÌýperpetratorÌýis a student at that institution, and/or
  • when the victim is a student involvedÌýin anÌýoff­ campus sexual assault.

Human Dignity Rights

  • To be free from any suggestion that victims must report the crimes to be assuredÌýof any other right guaranteedÌýunderÌýthisÌýpolicy.
  • To have any allegations of sexual assault treatedÌýseriously; the right to be treated with dignity.
  • To be free from any suggestion that victims are responsible for the commissionÌýof crimes against them.
  • To be free from any pressure from campus personnel to:
    • report crimes if the victim does not wishÌýto do so
    • report crimes as lesser offenses thanÌýthe victim perceives the crime to be
    • refrainÌýfrom reporting crimes
    • refrainÌýfrom reporting crimes to avoidÌýunwantedÌýpersonal publicity.

Rights to Resources On and Off CampusÌý

  • To be notifiedÌýof existingÌýcampus and community basedÌýmedical, counseling, mental healthÌýandÌýstudent services forÌývictims of sexual assault whetherÌýor not the crime is formally reportedÌýto campus orÌýcivil authorities.
  • To have access to campus counseling underÌýthe same terms and conditions as apply to otherÌýstudents inÌýtheir institutionÌýseekingÌýsuchÌýcounseling.
  • To be informedÌýof and assisted inÌýexercising:
    • any rights to confidential orÌýanonymous testing for sexually transmitted diseases, humanÌýimmunodeficiency Ìývirus, and/orÌýpregnancy
    • any rights that may be providedÌýby law to compel and disclose the results of testing of sexual assault suspectsÌýfor communicable diseases.

Campus Judicial Rights

  • To be affordedÌýthe same access to legal assistance as the accused.
  • To be affordedÌýthe same opportunity to have others present during any campus disciplinary proceeding that is allowedÌýthe
    accused.
  • To be notifiedÌýof the outcome of the sexual assault disciplinary proceedingÌýagainst the accused.

Legal RightsÌý

  • To have any allegationÌýof sexual assault investigated and adjudicatedÌýby the appropriate criminal andÌýcivil authorities of theÌýjurisdictionÌýinÌýwhichÌýthe sexual assault is reported.
  • To receive full and prompt cooperationÌýandÌýassistance of campus personnel inÌýnotifyingÌýthe proper authorities.
  • To receive full, prompt, andÌývictim­ sensitive cooperationÌýof campus personnel with regard to obtaining, securing, andÌýmaintaining evidence, including a medical examination whenÌýit is necessary to preserve evidence of the assault.
  • To be free from any suggestion that victims were contributory negligent or assumedÌýthe riskÌýof beingÌýassaulted.

Campus Intervention RightsÌý

  • To require campus personnel to take reasonable andÌýnecessary actions to prevent further unwantedÌýcontact of victims by theirÌýallegedÌýassailants.
  • To be notifiedÌýof the options for andÌýprovidedÌýassistance inÌýchangingÌýacademic andÌýlivingÌýsituations if suchÌýchanges areÌýreasonably available.

Statutory Mandates

Each campus must guarantee that this Bill of Rights is implemented. It is the obligation of the individual campus governing board to examine resources dedicated to services required to implement the Bill of Rights and to make appropriate requests to increase or reallocate resources where necessary to ensure implementation. Each campus shall make every reasonable effort to ensure that every student at that institution receives a copy of this document. Nothing in this act or in any “Campus Assault Victim’s Bill of Rights” developed in accordance with the provisions of this act, shall be construed to preclude or in any way restrict any public or independent institution of higher education in the State from reporting Ìýany suspected crime or offense to the appropriate law enforcement authorities.
